Trademark Policy
Effective Date: January 31, 2026
What is RedCarpetHQ's Trademark Policy?
Using another party's trademark-protected materials in a way that confuses or misleads others may be considered trademark infringement. RedCarpetHQ is not in a position to mediate trademark disputes between producers and trademark owners. RedCarpetHQ may in its discretion perform a limited investigation of reasonable complaints and may remove or disable access to content in clear cases of infringement.
Important Note on Blockchain: While RedCarpetHQ can remove or disable access to campaign pages and content on our platform, certain information recorded on the blockchain (such as token names and symbols) is immutable and cannot be removed. We strongly encourage producers to conduct thorough trademark searches before launching campaigns and creating tokens.
What Do I Do If I Believe Someone Is Infringing My Trademark?
Trademark owners should make every attempt to resolve a trademark dispute directly with the producer by messaging them directly from the campaign page.
If you're unable to reach a resolution with the producer, you can report a trademark violation by emailing the following information to copyright@redcarpethq.org (please note that all information must be submitted in English):
Required Information:
1. URL of infringing campaign
2. Trademarked word or symbol
3. Registration number
4. Registration office (e.g., USPTO, EUIPO, IPOS - Intellectual Property Office of Singapore, or other national trademark office)
5. Details — How does the campaign violate your trademark? Please provide specific information and grounds for your complaint, including:
6. Your full legal name
7. Your email address (please use company email address)

How Does RedCarpetHQ Respond to Reports of Trademark Infringements?
RedCarpetHQ respects the trademark rights of others and takes reports of trademark infringement very seriously. After you report a violation, RedCarpetHQ will review your submission and take whatever action, in its sole discretion, it deems appropriate. This may include:
Timeline: We aim to review trademark complaints within 5-7 business days. Complex cases may require additional time for investigation.
Notification: The producer will be notified of the complaint and given an opportunity to respond, unless doing so would compromise an ongoing investigation or legal proceeding.
RedCarpetHQ may in its sole discretion terminate user accounts that are repeat infringers of the intellectual property rights of others. RedCarpetHQ also reserves the right to terminate user accounts based on even a single instance of infringement.
Blockchain Considerations for Trademark Disputes
Token Names and Symbols:
When a campaign creates tokens on the blockchain, the token name and symbol become part of the immutable blockchain record. While RedCarpetHQ can:
We cannot:
Timing Matters: If you discover a potential trademark infringement, it's crucial to report it as early as possible, ideally before the campaign graduates and tokens become tradable. Once tokens are deployed and distributed, remediation options become more limited.
For Graduated Campaigns: If a campaign has already graduated and tokens are in circulation, trademark owners may need to pursue legal remedies directly with the producer, as blockchain records cannot be altered.
What If My Campaign Receives a Trademark Complaint?
If your campaign is the subject of a trademark complaint, you will receive an email from RedCarpetHQ with:
1. Details of the complaint
2. The trademark owner's contact information (unless withheld for legal reasons)
3. Instructions for responding to the complaint
4. A deadline for your response (typically 7 business days)

Token Naming Best Practices:
Fair Use and Nominative Use
In some cases, use of a trademark may be permissible under fair use or nominative use doctrines. However, these are complex legal concepts that vary by jurisdiction. Examples might include:
Important: Fair use and nominative use are affirmative defenses that must be evaluated on a case-by-case basis. If you believe your use qualifies, consult with a trademark attorney and be prepared to provide detailed justification.
International Trademark Considerations
RedCarpetHQ operates globally, and trademark rights vary by jurisdiction. When evaluating trademark complaints, we consider:
Multi-Jurisdictional Disputes: If a trademark is registered in multiple countries, we may take action based on the registration in the jurisdiction most relevant to the dispute.
Repeat Infringers
RedCarpetHQ maintains a record of trademark complaints and resolutions. Users who repeatedly infringe trademark rights may face:
Even a single instance of clear, willful trademark infringement may result in account termination.
