What is RedCarpetHQ's Copyright Policy?

RedCarpetHQ Pte. Ltd. is a Singapore-based company and complies with the Singapore Copyright Act 2021 and applicable international copyright laws. RedCarpetHQ respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with Singapore law and our procedures outlined below.

If you believe your copyright is being infringed, you can report the alleged violation.

If your campaign was the subject of a takedown notice, you can submit a counter-notification.

If you've supported a campaign that was the subject of a takedown notice, you can learn what that means.

RedCarpetHQ may, in its sole discretion, terminate user accounts of those who are repeat infringers of the intellectual property rights of others. RedCarpetHQ also reserves the right to terminate user accounts based on a single instance of infringement.

RedCarpetHQ does not control content hosted on third party websites or blockchain networks, and cannot remove content from sites or networks it does not own or control. If you are the copyright owner of content hosted on a third party site, and you have not authorized the use of your content, please contact the administrator of that website directly to have the content removed.

Important Note on Blockchain: Content and metadata stored on the blockchain (such as campaign token names, symbols, and certain campaign information) are immutable and cannot be removed once recorded. However, RedCarpetHQ can remove or disable access to campaign pages and associated content on our platform.

How Do I Report a Copyright Violation?

If you're not sure whether material on RedCarpetHQ infringes on your copyright, please consult with a qualified attorney before filing a takedown notification. Singapore copyright law and international copyright laws require you to consider copyright defenses, limitations, or exceptions, such as fair dealing, before sending a notice. If you misrepresent that material infringes your copyright, you may be subject to liability for damages under Singapore law.

If you have a good faith belief that any materials accessible on or from https://www.redcarpethq.org/ (the "RedCarpetHQ Platform") infringe your copyright, you may request removal of those materials (or access to them) from the RedCarpetHQ Platform by filing a takedown notification ("Takedown Notice") by contacting us at copyright@redcarpethq.org.

In accordance with the Singapore Copyright Act 2021, your written notice must include substantially the following information (please note that all information must be submitted in English):

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest

2. A description of the copyrighted work that you claim has been infringed, including:

  • The nature of the copyright work (e.g., literary, artistic, musical, dramatic)

  • Evidence of copyright ownership (e.g., registration details, creation date)

    • 3. A description of where the material that you claim is infringing is located on the RedCarpetHQ website, in a sufficiently precise manner to allow RedCarpetHQ to locate the material - please be as specific as possible, including:

  • The title of the work

  • The campaign URL

  • The type of media

  • Any other identifying information

    • 4. Adequate information by which we can contact you (including your name, your postal address, your telephone number, and your email address)

    5. The following statements:

  • "I have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law (including fair dealing exceptions under Singapore law)"

  • "I hereby state that the information in this notice is accurate and I am the copyright owner or authorized to act on behalf of the owner of the copyright that is allegedly infringed"

  • "I understand that I may be liable for damages under Singapore law if I knowingly materially misrepresent that the reported material is infringing"

    RedCarpetHQ processes Takedown Notices in accordance with Singapore law. Please note that RedCarpetHQ reserves the right to request additional information from you to assist us in processing a Takedown Notice, and may not take final action on a Takedown Notice until all requirements are satisfied. We reserve the right to refuse to action a Takedown Notice if any of the required information is omitted or not substantially complete.

    What Happens If I Receive a Takedown Notification About My Campaign?

    If RedCarpetHQ receives a takedown notice about your campaign, our policy is to remove the infringing material or disable access to your campaign until the dispute is resolved. RedCarpetHQ reserves full discretion to determine whether the campaign is hidden in full or in part.

    You will receive an email from RedCarpetHQ attaching the claimant's Takedown Notice and providing instructions for filing a counter-notification if you wish to dispute it. RedCarpetHQ processes Takedown Notices and counter-notifications for adherence to legal formalities only; we cannot and will not adjudicate the validity of any claim of copyright infringement or whether a defense like fair dealing may apply.

    Blockchain Considerations: While we can hide or disable your campaign page on our platform, please note that certain information already recorded on the blockchain (such as token names, symbols, and transaction history) cannot be removed as blockchain records are immutable.

    How Do I File a Counter-Notification to Dispute the Claims?

    If your campaign is the subject of a Takedown Notice and has been hidden or disabled, and you believe that your campaign or the material it includes is not infringing or that you have authorization or a right to post and use that material from the copyright owner or pursuant to law (including fair dealing exceptions), you can submit a counter-notification to RedCarpetHQ's copyright agent by emailing us at copyright@redcarpethq.org.

    Your counter-notification must contain the following information (please confirm these requirements with your legal counsel). Please note that all information must be submitted in English:

    1. Your physical or electronic signature

    2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled

    3. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material

    4. Your name, address, telephone number, and email address

    5. A statement that you consent to the jurisdiction of the Singapore courts for any dispute arising from this matter, and that you will accept service of process from the person who provided the Takedown Notice, or an agent of such person

    6. An explanation of why you believe the material does not infringe copyright, including any applicable defenses such as:

  • You own the copyright

  • You have permission from the copyright owner

  • The use qualifies as fair dealing under Singapore law

  • The material is not protected by copyright

    Under Singapore law, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability for damages.

    RedCarpetHQ will process counter-notifications in a reasonable timeframe. Please note that RedCarpetHQ reserves the right to request additional information from you to assist us in processing a counter-notification, and may not take final action until all requirements are satisfied. We reserve the right to refuse to action a counter-notification if the required information is omitted or incomplete.

    What Happens After I Submit a Counter-Notification?

    After RedCarpetHQ receives your counter-notification, we'll forward it to the person that submitted the Takedown Notice. If we do not receive notice within 14 business days after forwarding the counter-notification that the copyright owner has filed legal action in Singapore courts or other appropriate jurisdiction to prevent alleged infringement, RedCarpetHQ may reinstate the campaign at issue in its sole discretion.

    Access to your campaign or to the allegedly infringing material will remain disabled after we receive your counter-notification until the dispute is resolved or until 14 business days have passed without notification that legal action has been filed. During this time, you will still have the option to message your supporters, edit your campaign (where permitted), or cancel your campaign.

    Will Anyone See My Takedown Notification or Counter-Notification?

    Yes. RedCarpetHQ is committed to transparency when it comes to requests that disable or hide access to content on our platform. We may publish information about Takedown Notices and counter-notifications in accordance with our transparency practices.

    Personally-identifying information such as the claimant's email and telephone number will be removed from published notices. However, a claimant's or counter-claimant's name, address and company name (if provided) may be shared as necessary for the dispute resolution process. You consent to such disclosure when you submit your Takedown Notice or counter-notification.

    RedCarpetHQ reserves the right to forward all materials received (including full contact details) to the opposing party in the copyright dispute. This is necessary for proper dispute resolution and compliance with Singapore law.

    What Happens to My Contribution If the Campaign I Supported Is Subject to a Copyright Dispute?

    If a campaign you've supported becomes the subject of a copyright dispute and RedCarpetHQ removes part or all of the campaign from public view, you'll get an email that explains the status and next steps. Any material that becomes subject to a copyright dispute will be removed or access disabled until the dispute is resolved.

    Sometimes this is a very short period of time - please be patient and reach out directly to the producer if you are concerned. If a campaign or any of its contents are removed or hidden from view because of a dispute, you'll still be able to manage your contribution by going to the campaign page.

    Please note that because RedCarpetHQ is only following legal processes and not making an assessment on the underlying claim of infringement, you shouldn't assume that the producer has engaged in an act of infringement, or that no infringement exists if a campaign is restored.

    For Active Campaigns:
    If we aren't able to re-post the campaign within 30 days, we will cancel it, and supporters will be able to claim refunds by burning their tokens. If the dispute is resolved within 30 days, the campaign will be restored to public view. We'll update you by email if any of these steps are taken.

    For Graduated Campaigns:
    If a graduated campaign (one that has successfully completed and tokens are tradable) is subject to a copyright dispute, the campaign page may be hidden, but tokens will remain in holders' wallets and may still be tradable on the marketplace. Blockchain records cannot be altered or removed.

    How Do I Report a Campaign for Patent Infringement?

    RedCarpetHQ evaluates and takes action on claims of patent infringement in very limited circumstances. One of the reasons for this is that most of the time the reward that is the subject of the patent has not been manufactured when the campaign first launches.

    Notwithstanding, if you believe that a campaign is offering an item or service that infringes a valid and enforceable patent, please submit the valid patent registration number and a court order finding infringement of the patent by the campaign to copyright@redcarpethq.org. Given the complexity of patents, we require a court order in order to process these claims.

    Additionally, please be sure to include the following information in your message:

  • URL of infringing campaign

  • Your full legal name

  • Your email address (please use company email address)

  • Company name (optional)

  • Company street address (optional)

  • The following statements:

  • "I understand that RedCarpetHQ may provide third parties, including the affected user, with a copy of this complaint"

  • "The information in this complaint is true and correct and I am the patent holder or am authorized to act on the patent holder's behalf"

    • RedCarpetHQ will review claims of patent infringement and will remove from public view any campaign that is the subject of a court order finding infringement of a valid and enforceable patent.

    Trademark Infringement

    If you believe a campaign infringes your trademark rights, please contact us at copyright@redcarpethq.org with:

  • Description of your trademark and registration details

  • URL of the allegedly infringing campaign

  • Explanation of how the campaign infringes your trademark

  • Your contact information

  • Statement of good faith belief that the use is not authorized

    • We will review trademark infringement claims and take appropriate action, which may include removing or disabling access to the infringing content.
